Akwa Ibom 2023 Guber: Court Summons Enyong

Following an order granted by a Federal High Court in Abuja, Mr Michael Enyong of the Federal House of Representatives has been served through substituted means, a motion on notice by Pastor Umo Eno, for the setting aside of the judgment of the Court filed on January 26, 2023.

Similarly, a motion for stay of execution of the judgment filed on 27th January and all other processes in this suit have also been served the Plaintiff, Hon. Michael Enyong by substituted means.

This order had followed the persistent evasiveness of Hon. Enyong to be served by the Court.

In granting this order on Tuesday, the Court directed that Mr Enyong be served through pasting the motion on notice on His office at 342 Three Arms Zone, National Assembly Complex(House of Representatives) Federal Capital Territory Abuja or His Residence at No 10 Idris Kutigi Street, Asokoro Federal Capital Territory Abuja.

The Court also directed that the photographed evidence showing the premises where the processes were served be filed in Court.

This order follows the filing of an 11 paragraph Affidavit submitted by Barrister Uwemedimo Nwoko(SAN) on behalf of Pst. Umo Eno, the Governorship candidate of the Peoples Democratic Party in Akwa Ibom State.

Barr. Nwoko had made the application LD on behalf of Pastor Eno, urging the Court to grant his prayer.

Take note that the case is in appeal against the Judgment of the Federal High Court which had granted Mr Michael Enyong the status of candidate of the PDP for the 2023 gubernatorial election.

However in a swift reaction, Pst Umo Eno through his counsel has sought to be joined in the suit filled by Mr Enyong which initially involved the Peoples Democratic Party(PDP) and the Independent National Electoral Commission(INEC).

Subsequently, Pst. Eno has also applied for an order to set aside that judgment and an order for a stay of execution as well as leave to be joined in the suit as an interested party.

With the service finally done by the court bailiff, the Federal High Court is expected to sit on Monday February 6, for the hearing on the suit.
